Parties listed below (collectively “Customer”) and PirateQuest, Inc,(the “Business”) (each a “Party” and collectively the “Parties”), in consideration of the goods, services or money exchanged, and / or in consideration of the Business making its premises available and open to the public of which the Customer is a member and / or in consideration of Customer entering upon the Business premises, hereby agree:
1. The nation and world have been gripped by an unprecedented situation in the current COVID 19 pandemic. While all agree that business like PirateQuest, Inc. are able to reopen and once again provide goods and services, all also agree that all should try to take reasonable precautions to preserve their own individual health, and the health of those around them in their community.
2. Further, while all Parties agree that each will make all reasonable efforts to comply with current government directives regarding opening, closing, employee and / or customer attire, and / or personal protective equipment (“PPE”) requirements and / or all other health and safety related directives and regulations, all agree that governmental directives have been fast moving and in some cases contradictory between state, federal and local directives. Accordingly, full compliance by all Parties cannot be absolutely guaranteed by any party at any time.
3. Further, given the varying symptoms, and sometimes symptomless nature of COVID 19 infections, all Parties realize that none of them can guarantee to any of the others that any business transacted between them will be absolutely secure from COVID 19 contamination and transmission. Therefore, the Parties agree:
A. If at any time any Party receives any information indicating any other Party may have come into contact with a possible source of COVID 19 transmission such that during the Parties contact with each other, an infection likely could have been transmitted between them, such Party will immediately inform the other Parties, using the contact information above, of any information reasonably available to it regarding such possible transmission that it may lawfully disclose without breach of any contractual obligation; and
B. Each of the Parties acknowledges and agrees that public interaction at this time is dangerous, and carries a risk of COVID 19 transmission and infection no matter where said public interaction takes place. Each Party specifically understands that dangers and hazards of COVID 19 include the risk of serious bodily injury or death. Each of the Parties assumes this risk in any interaction with any other party.
C. Each Party HEREBY RELEASES, WAIVES ALL CLAIMS AGAINST, AND DISCHARGES the others, and any directors, officers, agents and employees, shareholders, and / or members (“Releasees”) FROM ALL LIABILITY FOR ANY AND ALL LOSS OR DAMAGE, AND ANY CLAIM OR DEMANDS THEREFORE ON ACCOUNT OF ILLNESS OR INJURY TO PERSON OR PROPERTY OR RESULTING IN DEATH OF ARISING OUT OF OR RELATED TO THE TRANSMISSION OF OR ANY INFECTION WITH COVID 19.
